In consideration of participating in surfing, paddleboarding, dragon boat, or ocean education activities ("Activities") offered by Odysea Surf School & Ocean Lab ("Odysea"), located in Carolina Beach and Kure Beach, North Carolina, I, the undersigned, on behalf of myself and/or my minor child(ren), hereby agree to the following:
1. Assumption of Risk
I acknowledge that the Activities involve inherent risks, including but not limited to: drowning, near-drowning, impact with surfboards or watercraft, strong currents, waves, marine life, weather conditions, and other participants. I voluntarily assume all risks associated with participation in the Activities, whether known or unknown.
2. Release of Liability
To the fullest extent permitted by North Carolina law, I hereby release, waive, discharge, and covenant not to sue Odysea Surf School & Ocean Lab, its owners, directors, instructors, employees, volunteers, and agents (collectively "Released Parties") from any and all liability, claims, demands, losses, or damages arising out of or related to participation in the Activities, including claims arising from the negligence of the Released Parties.
3. Indemnification
I agree to indemnify and hold harmless the Released Parties from any loss, liability, damage, or cost they may incur arising out of or related to my participation or my minor child(ren)'s participation in the Activities.
4. Medical Authorization
I authorize the Released Parties to obtain emergency medical treatment for me or my minor child(ren) if necessary. I acknowledge that I am responsible for all costs of such treatment. I represent that all participants are in good physical health and capable of participating in water-based activities.
5. North Carolina Governing Law
This agreement shall be governed by the laws of the State of North Carolina. If any provision of this agreement is found to be unenforceable, the remaining provisions shall remain in full force and effect.
6. Media Release
I hereby grant Odysea Surf School & Ocean Lab permission to photograph, video record, and use images or footage of myself and/or my minor child(ren) taken during Activities for promotional, educational, and marketing purposes, including but not limited to use on the Odysea website, social media channels, and printed materials. No compensation will be provided. I waive any right to inspect or approve finished materials.
7. Acknowledgment
I have read this agreement carefully, understand its terms, and sign it freely and voluntarily. If signing on behalf of a minor, I represent that I am the parent or legal guardian of the minor participant(s) and have the authority to execute this agreement.
